Cancellation Policy

We strive to create an intimate community atmosphere during your stay and as a result, we can only accommodate a limited number of guests. It is the responsibility of the guest to read, understand and agree to our cancellation policy before booking with us.

• All bookings incur a 50% booking deposit. This is included in the full price of the retreat booking. If you wish to cancel, the deposit is non-refundable.
• If you fail to arrive on the date of your retreat stay, arrive on a date other than your confirmed booking date, or you leave early, your payment is non-refundable and the booking is non-transferrable to another date.

Insurance

If you are travelling from overseas, we ask that you have travel insurance. Nagnata does not take any responsibility for changes in travel plans, change of mind, or transport changes.

Liability for Retreat Participants

Nagnata Retreat organisers take no responsibility or liability for, and the participant waives any right to hold this retreat’s organisers liable for:

• Any changes or delays in air schedules, missed airlines or others carrier connections or other services;
• Any changes with the travel restrictions from any others Australian states other than NSW;
• Injury, loss, or damage to persons or property, including luggage;
• Additional expenses resulting from changes in exchange rates, tariffs or schedule;
• Additional expenses incurred or due to sudden sickness, weather conditions, strikes or other causes or acts of God;
• Losses due to cancellations.
• Travel insurance is recommended. 

Parking Policy

Please park cars in allocated parking spots. Parking on the grass or anywhere outside of the allocated parking will incur a $1,000 fine. 

Shooting Content at Soma Byron Bay

During your stay, professional shoot (photography, videography, aerial image or footage) is not permitted at Soma. For formal photo shoots at Soma you must inquire with Soma itself. If you would like to take are candid photos of your retreat experience at Soma, share them on social media and tag Soma clearly in the description and location with @soma.byron. You cannot use such content to promote your personal brand, on your website and/or commercially. 

Video and Photography Consent

By attending this event site you agree to being filmed or photographed which may be used for marketing or promotional purposes

Nagnata Voucher

All vouchers are applicable for use towards Nagnata retreats. It is important to note that a voucher holds no cash redemption value. To facilitate the utilisation of this voucher, we kindly request that you reach out to our customer service team via email at customercare@nagnata.com.

Insurances

All retreat facilitators must send their insurances to Nagnata upon booking. Facilitators insurance must be up to date and valid over the period of time they are conducting their retreat at Soma.

Check-in / Check-out

Check-in time is 2:00 pm and check out is 10:00 am. No refunds will be given on early departure and any outstanding balance will be deducted from the credit card provided.

Maximum Capacity Soma

Soma has 10 bedrooms, each with one king size bed and two rooms that can be split into king singles. We only can split beds in two of the eight bedrooms.

Vegetarian and Alcohol Free Venue

Soma is strictly a vegetarian and alcohol free venue unless permitted otherwise by our team. We also have a strict no-party policy. Eating meat is the single biggest cause of deforestation and climate change. We would like to do our part in reducing the impact our retreats have on the planet. We kindly ask that you keep this in mind when you choose your caterer and menu. We have made a decision to prohibit alcohol on our property. To truly transform we believe we need to leave all that society has conditioned us behind. Soma is a sanctuary and a place of transformation, and for a true change, we believe in the need to be sober and in tune with ourselves. We thank you for understanding.

Behaviour & Noise Policy

Soma is a retreat space and do not tolerate parties on the property. Please respect our neighbours and other guests and keep noise to a minimum. Unreasonable noise will not be tolerated after 10:00 pm. Bond will be lost if noise does not cease after 10:00 pm. We reserve the right to request people who are making too much noise at any time of the day or night to leave. A security company or police may be called to investigate complaints of excessive noise or anti-social behaviour. Any charges incurred by the security company or police will be charged to the credit card provided as security for the booking.

Maintenance

Please note that Soma is a large property that requires regular maintenance and general servicing at times. Whilst we do our best to minimise any disturbance for your group we wanted to let you know that some works may be carried out during your stay such as; lawn mowing, pool maintenance, gardening and other general repairs. We thank you for your understanding.

Cleaning & Laundry

The rooms and bedding will be cleaned only after your departure. The costs of these services are included in the venue hire. If you would like the rooms to be cleaned during your stay, please let the Soma team know and we will organise the logistics of these services for an additional cost. If you’d like the common areas to be cleaned curing your stay, you can also request this at an additional cost.

Payment Details

A 50% non-refundable deposit is required to confirm your booking. A valid credit card is required for a security bond on all bookings made. Please note that there will be a credit card surcharge of 2% for Australian cards and 2.9% for international cards.

Cancellation Policy

If there are no NSW Government restrictions, retreat bookings cannot be canceled or moved on any other basis. As a retreat facility we do not carry any liability of facilitators utilising our property. It is each facilitator’s responsibility to fill and operate their retreat. Nagnata takes no responsibility for any external facilitators or their guests. If you wish to cancel your booking then our cancellation policy will apply: if you need to cancel your booking before 90 days of your retreat, you will not receive the non-refundable deposit. If you cancel within 90 days of the retreat, you will not get any refund. If you need to reschedule your retreat, you need to do this within a 12 month period from when you are rescheduling.

Trading Terms

Nagnata reserves the right to release any or all room space if payment terms are not met.

Force Majeure

Nagnata will not be in breach of this agreement, or any way liable to any party, if it is prevented from complying with this agreement by reason of act of God, act of public enemy, act of terrorism, war, earthquake, riot, explosion, pandemic, compliance with any law or government restraint order, rule regulations, strike, lockout or any other cause not reasonably within the control of Nagnata Pty Ltd. In the event of a force majeure, Nagnata Pty Ltd will seek to move the retreat date within 12 months from the original booking window.

Additional charges

Management of Soma Byron Bay reserves the right to charge guests for the following, but not restricted to, all damages and breakages, lost keys, towels and missing items, late departure and extra cleaning. Any additional charges will automatically be charged to the credit card provided as security for the booking following at least one attempt to contact the credit cardholder.

Smoking Policy

All rooms are non-smoking including decks, poolside and dining areas. All rooms are non-smoking including decks, poolside and dining areas. Any traces of residual smoke inside will incur bond will be deducted. 

Drugs and Illegal Substances

It is prohibited to use illegal drugs or any other illegal substances at Soma or practice any illegal activities.

Candles Policy

No candles to be lit anywhere on the property, in the house or any treatments rooms.

Lost Key

A $40 charge will apply if the house keys are not returned or lost.

Pets

Pets are not permitted on Soma’s grounds.

Privacy Policy

Nagnata is subject to the National Privacy Principles in the Privacy Act 1988. We will generally collect personal information about you directly from you when you deal with us over the telephone or by letter or e-mail. Normally, the type of personal information collected by us will include your name, address, telephone number and e-mail address. We may use your personal information for some or all of the following purposes:

• provide marketing information to you about our products and services

• to monitor the standard and quality of service we provide to your or other guests

If you do not wish to receive these communications from us, you may unsubscribe. If you choose to send email messages to us that contain confidential, private or personal information, you do so entirely at your own risk.

Governing Law

The Law of New South Wales governs your use and occupation of the property during this reservation.

You agree to submit to the exclusive jurisdiction of the Courts of New South Wales.

Shooting Content at Soma for your Retreat

Please note that Soma Byron Bay have had to implement certain stipulations with regards to photography and videography at Soma. During your retreat, professional shoot (photography, videography, aerial image or footage) is not permitted at Soma. For formal photo shoots at Soma promoting future retreats or other aspects of your brand/work, you must inquire. Depending on the content and usage, we may be able to approve the shoot. In the event that the shoot is approved, we will provide a separate quote. Facilitator estimated costs can range from $5000-$10000 per day, depending on content and property usage. 

Soma Byron Bay is fine for you and your guests to take candid photos of your retreat experiences, share them on social media and tag Soma clearly in the description and location with @soma.byron. You cannot use such content to promote your brand, future retreats not at Soma, on your website and/or commercially.
